Too late 😂&amp;quot;&lt;/p&gt;&#10;&lt;p&gt;Monday, March 17, 5:00 p.m.: Judge holds hearing to determine what exactly went down, and when. (This is the hearing I sat in on, and when I heard the lawyer for the administration emphasize several times that &amp;quot;no planes took off from any U.S. territory after the verbal order.&amp;quot;)&lt;/p&gt;&#10;&lt;p&gt;During the hearing the Trump administration&amp;#39;s arguments were Plane 3 took off after the written order (which didn&amp;#39;t have the &amp;#39;any planes in the air&amp;#39; language) was issued, and that:&lt;/p&gt;&#10;&lt;p&gt;a) The written order supersedes the oral order, and the written order does not say anything about &amp;quot;any airplanes in the air needed to turn around&amp;quot;, and so the administration believes that it complied with the order;&lt;/p&gt;&#10;&lt;p&gt;AND / OR&lt;/p&gt;&#10;&lt;p&gt;b) That at the time that the order was made the plane was already in the air *outside of U.S. airspace*, so not subject to the jurisdiction of the court&amp;#39;s injunction, and so the administration believes that it was not in violation;&lt;/p&gt;&#10;&lt;p&gt;AND / OR&lt;/p&gt;&#10;&lt;p&gt;c) All of the people on Plane 3 that went to El Salvador were there under *other* laws and acts, *not* under the president&amp;#39;s Alien Enemies Act proclamation (this is somewhat plausible as some of those deported were members of the Tren de Aragua gang which has been designated a terrorist organization, making them deportable under other laws), and so the administration believes that it wasn&amp;#39;t in violation of the order and/or that it didn&amp;#39;t have to follow the order owing to lack of jurisdiction;&lt;/p&gt;&#10;&lt;p&gt;AND / OR&lt;/p&gt;&#10;&lt;p&gt;d) That the president, as the executive and as the commander in chief of the military, has supremacy when it comes to matters of national security, and so that it didn&amp;#39;t have to follow the order owing to lack of jurisdiction and a conflict with the constitution.&lt;/p&gt;</description>
